Mark Faction Writes CJN Over Delay In Judgment


A faction of the African Democratic Congress (ADC) led by the former Senate President, David Mark, has formally written to the Chief Justice of Nigeria (CJN), Justice Kudirat Kekere-Ekun, urging the swift delivery of judgment in the ongoing leadership dispute within the party.

New Telegraph reports that the request by the Mark-led faction followed the decision of the Supreme Court of Nigeria to reserve judgment in an appeal filed to challenge earlier rulings on the crisis.

The appeal, marked SC/CV/180/2026, stems from a March 12 judgment of the Court of Appeal, which directed parties to maintain the status quo ante bellum in a suit instituted by aggrieved members of the party.

Mark’s faction has argued that the appellate court overstepped its bounds by intervening in what it described as the internal affairs of a political party.

In a letter dated April 28, 2026, and signed by the party’s counsel, Shaibu Enejoh Aruwa, the faction warned that any delay in delivering the judgment could have far-reaching consequences for the party’s participation in the 2027 general elections.

“Without the delivery of judgment within the next three days from the date of this letter, the ADC stands the grave and irreversible risk of being excluded from participating in the 2027 General Elections,” the letter stated.

The faction further argued that such a scenario would disenfranchise millions of Nigerians and deny them the constitutional right to contest elections under the platform of the party.

The leadership tussle dates back to a September 4, 2025, ruling of the Federal High Court in a suit filed by a rival factional chairman, Nafiu Bala, challenging the takeover of the party by the Mark-led group. The appellate court later dismissed Mark’s appeal, prompting the move to the apex court.

The letter also referenced actions by the Independent National Electoral Commission (INEC), which reportedly de-recognised the party’s leadership in line with the lower court ruling, leaving the ADC without a clear leadership structure.

“My Lord, the ADC’s ability to comply with these statutory requirements to participate in the 2027 General Elections is wholly dependent on the timely delivery of the judgment in the instant appeal,” the letter added.

The faction stressed that the matter is time-sensitive, noting that preparations for the 2027 elections are already underway, and urged the court to intervene to prevent what it described as “irreparable harm” to the party and its members nationwide.

The Supreme Court is yet to announce a date for the delivery of its judgment.
