Deploy administrative proceedings for dispute resolution, CAC urges businesses


The Corporate Affairs Commission has urged businesses in the country to make use of its Administrative Proceedings Committee to resolve corporate disputes.

In a statement issued on Friday via its official Instagram handle, the CAC called on businesses, clubs, associations, and non-governmental organisations to take advantage of the APC to resolve grievances without resorting to prolonged litigation.

The Administrative Proceedings Committee is a provision of CAMA 2020, designed to ensure ease of doing business and promote sustainability for registered entities.

According to the commission, the APC serves as a platform for individuals or organisations with complaints regarding a registered entity to seek redress. The committee is empowered to hear non-criminal disputes and recommend prosecution for crime-related matters.

“The APC will adjudicate on issues arising from the operations of entities or associations. Any decision taken by the committee, once confirmed by the CAC board, becomes the Commission’s official position,” the statement added.

The CAC also clarified that any aggrieved party dissatisfied with the APC’s decision has the right to appeal at Federal High Court, which serves as the appellate jurisdiction for such matters.

Business owners and organisations were urged to embrace this alternative dispute resolution mechanism instead of engaging in lengthy legal battles that could stifle economic growth.

“We encourage all stakeholders to utilise this provision to amicably resolve disputes rather than pursuing litigation that could hinder business operations. The introduction of the APC aligns with the Federal Government’s broader agenda of enhancing the ease of doing business in Nigeria, reducing bureaucratic bottlenecks, and fostering a more conducive business environment,” the commission advised.
